Contacting your state health department is a good place to start! If your state health department has no idea, you may want to reach out to your local health department to see if those folks can help you get to the bottom of things.
You may want to reach out to local herbalists in your state who sell products to clients or the public and see if of these folks can give you some guidance. In a similar vein, you may want to research if other large tincture companies like Herb Pharm sell their products in your state which may give you some insight into whether or not it is illegal to sell tinctures without a liquor license.
Finally you may want to research what constitutes selling alcohol in your state. For example, does it have to be a certain amount/volume, or is it in the labeling and intended use of the product? Most large sized tincture companies sell in 1, 2, or 4 ounces, but not greater than that. In fact, most are the smaller sizes in stores, with larger sizes sold online.
